December’s landmark decision should cause us to concur with Francis P. Church, editor of the The New York Sun in 1887, who said, "Yes, Virginia, there is a Santa Claus." And true to form, Santa checked his list and then checked it twice, but then he let the Supreme Court tell us who was naughty or nice. [View Full Issue]

December 1997 Issue
Unless you’ve been off the planet or outside reality’s touch, you have no doubt learned of the Supreme Court’s ruling in Kunkel v. Walton. The Court declared that requiring a plaintiff to consent to a full and unrestricted disclosure of his/her medical history was unconstitutional. Without dissent, the Court held that section 2-1003(a) of the Code of Civil Procedure, as amended by the Civil Justice Reform Act of 1995, violated the separation of powers and privacy provisions of the Illinois Constitution of 1970. Well, October and Halloween have come and gone with our Supreme Court giving us neither trick nor treat. Regardless of what is ultimately bestowed, none could argue that this organization has not acted in exemplary fashion. Our united efforts to thwart the overhaul of victims’ rights proudly affirms the principles and dedication of the Illinois Trial Lawyers Association. Therefore, as we approach November’s Thanksgiving, maybe we should pause and reflect on the concept it embodies. [View Full Issue]
