February 2000 Issue
Public Act 91-526 made changes to 210 ILCS 85/6.17, part of the Hospital
Licensing Act. The former section contained three provisions that related
to access to patient records for federally designated organ procurement
agencies and tissue banks. The amendments created by P.A. 91-526, effective
1/1/00 provide six new subsections. [View

January 2000 Issue
While I do not typically use this column to report cases of significance
to our membership, every now and then a real gem is decided and I can’t
refrain. Such is the case of Clayton v. Ingalls Memorial Hospital,
No. 1-98-3689, (1st. Dist. 1/6/00). The court held that 820 ILCS 305/16
requires one issuing an Industrial Commission subpoena duces tecum to
pay only a $20/day witness fee and a $.20/mile travel fee to the deponent
and does not require the subpoenaing party to pay any other fees, including
per-page copy fees, retrieval fees, or any other expenses claimed by subpoenaed

November/December 1999 Issue
The Supreme Court Rules Committee is soliciting public comments regarding
proposed rule changes. Of particular interest to our membership is a proposed
amendment to Rule 212(a) that would permit the use of a discovery deposition
at trial when the deponent is unable to be present due to illness or death.
Additionally, a proposed amendment to Rule 204(c) limits the length of
the deposition of a non-party physician to one hour and limits the deponents’
fee to $450/hour absent a court order. [View

October 1999 Issue
On September 30, 1999 the Illinois Supreme Court issued a landmark decision
in William Petrovich, Adm’r of the Estate of Inga Petrovich,
et al.,v. Share Health Plan of Illinois, Inc, docket No. 85726. The
plaintiff, who was a member of a health maintenance organization (HMO)
sued the HMO for medical malpractice, alleging that the HMO was vicariously
liable for the conduct of the participating physician who treated her.
The Supreme Court held that: (1) an HMO may be held vicariously liable
for the negligence of its independent-contractor physicians under the
doctrine of apparent authority, (2) such liability may also be imposed
under the doctrine of implied authority; and (3) fact issues entitled
the patient to a trial under both doctrines. [View

September 1999 Issue
Dudley Scholarship Recipient Named
I recently named Northwestern University School of Law as recipient of
the Dudley Scholarship Award for 1999. The fund was created as a lasting
memory to Jim Dudley who was ITLA Executive Director from 1981 to 1992.
Former ITLA President Dave Decker will make the presentation of approximately

July 1999 Issue
In addition to the standing committees, we have formed a Civil Rights
& Employment Law Committee as well as a Grants & Contributions
Committee. The Civil Rights & Employment Law Committee was formed
to fill a void that none of the standing committees covered in this burgeoning

On Friday, June 11, 1999, I became the 46th President of the Illinois
Trial Lawyers Association and after a year of distinguished service, Martin
J. Healy Jr. was bestowed the title “Immediate Past President”.
We all owe a debt of gratitude to Marty for his tireless efforts on behalf
of our organization. He sacrificed professionally and personally. [View
